Cannabis is an addictive substance within the meaning of the Addictive Substances Act and Regulations. According to the Government Regulation on Addictive Substances, cannabis extract and tincture are also addictive substances.
The Addictive Substances Act prohibits the cultivation of species and varieties of the cannabis plant (genus Cannabis) that may contain more than 0.3% of substances of the tetrahydrocannabinol group. Varieties of cannabis containing less than 0,3 % THC are called technical cannabis. According to the Law on Addictive Substances, when growing technical hemp on an area larger than 100 m2 , this must be reported to the local customs authority.
If the hemp is grown for commercial purposes, it must be a registered variety according to Act No. 219/2003 Coll., on the marketing of seeds and seedlings of cultivated plants (hereinafter referred to as the "Seed Act"). Furthermore, if the technical hemp is grown for purposes other than industrial, technical and horticultural purposes, a permit to handle addictive substances is required .
In addition to CBD extracts and other cannabinoids, the resulting products may be further processed products such as cosmetic or food products.
