An Effective Defense Against the CEI's Decision
ARROWS Law Firm represented a client in administrative proceedings conducted by the Czech Environmental Inspectorate (ČIŽP), in which the client faced a fine for an alleged violation of environmental regulations. The key objective was to challenge the regulatory authority’s legal conclusions and minimize the financial impact of the decision. Thanks to the chosen defense strategy and a meticulously drafted appeal, the firm succeeded in securing a significant reduction in the penalty.

ARROWS provided legal representation to the client following the issuance of a decision by the Czech Environmental Inspection Authority (ČIŽP) imposing a fine in the hundreds of thousands of crowns for violations of waste management obligations. After a detailed analysis of the inspection report and the administrative decision, ARROWS identified significant procedural and substantive deficiencies, particularly the disproportionately high amount of the penalty imposed without proper justification and the failure to consider mitigating circumstances on the client’s part. Based on this, a strategy was chosen to file a comprehensive appeal, the aim of which was to systematically challenge, above all, the method used to determine the amount of the penalty. This approach was chosen as the most effective because it allowed for a remedy to be achieved directly within the administrative proceedings without the need to initiate judicial review.
ARROWS prepared a detailed appeal, including legal arguments based on administrative practice and case law, with a key emphasis on the proportionality of the penalty and procedural errors by the inspection authority. At the same time, the firm supplemented the relevant evidence and actively responded to requests from the superior administrative authority. The result was a reconsideration of the original decision and a significant reduction in the imposed fine. The client thus minimized the financial impact of the proceedings and, at the same time, received recommendations for adjusting internal processes to eliminate similar risks in the future.
