Precise defense by ARROWS halted criminal proceedings for alleged misuse of know-how

We successfully defended a client facing serious charges of committing a criminal offense of violating competition rules (unfair competition) by breaching trade secrets. Thanks to our thorough work with evidence and precise argumentation, we achieved the complete dismissal of criminal proceedings.

We took over the defense of a client against whom the regional directorate of the criminal police had initiated criminal proceedings for a criminal offense, which was alleged to consist in the fact that the client, who was employed as a sales representative for a company engaged in the purchase and supply of metal materials and products throughout Europe, after the termination of his employment, misused the know-how and trade secrets of this company, consisting of lists of the company's established exclusive customers and the method of pricing commercial offers to these and other customers, and began to use this non-public protected data for unfair competition against his former employer, thereby "diverting" orders worth approximately CZK 9,000,000.

We vigorously defended our client against the criminal proceedings, which consisted mainly of refuting the argument of the criminal investigation authorities that the know-how and information used by the client for his further business activities were trade secrets of the allegedly aggrieved company, both through carefully selected and applied evidence, which, together with the active involvement of the client under our guidance, proved that it was in fact the client's own know-how acquired completely outside the sphere of the allegedly affected company, as well as pointing out fundamental weaknesses in the evidence, contradictions, and the overall incorrect factual and legal understanding of the case by the law enforcement authorities in the very concept of the criminal proceedings initiated. Under the weight of this argument and the evidence we presented, we succeeded in clearing the client of all charges, with the criminal proceedings against the client being dismissed in their entirety.
