ARROWS represented the municipality in a court case against a Dutch investor regarding the planned construction of a biogas plant.
Although the municipality initially agreed to implement the project, it later changed the zoning plan based on residents' concerns about environmental impacts, making construction impossible. The investor subsequently demanded compensation for damages, which led to a court case, the outcome of which was crucial not only for the financial stability of the municipality, but also for the protection of the rights of municipalities to make decisions about their territory.
Legal support included comprehensive representation of the client in court, preparation of the defence and negotiation of strategic documents for the court proceedings. The team also coordinated all communications between the municipality, its officials and other stakeholders to ensure maximum preparedness for trial. The result was a final dismissal of the lawsuit, which meant that the municipality was not required to pay the requested damages and was able to proceed with its development plans without the financial burden of the litigation.
