Representing one of the largest employers of PWD in a key state aid case

13.12.2024

ARROWS represented one of the largest employers of persons with disabilities in the Czech Republic in proceedings concerning the award of a disability employment allowance of approximately CZK 65 million for the disputed calendar quarter.

Although the subsidy was initially granted, the client was subsequently ordered to partially repay it due to alleged violations of the conditions for the operation of the protected labour market. Given the importance of this state support for the continuation of the client's activities and the impact of the decision on the entire PWD employment sector, this is a landmark case with wider implications for the labour market in the Czech Republic.

The legal representation included not only defending the client against the demand for repayment of the subsidy, but also strategically ensuring the protection of his rights in the ongoing administrative proceedings. The team was involved in analysing the legal aspects of the state aid, formulating key arguments and negotiating with the authorities to prevent destabilisation of the funding of the protected labour market.

The team was led by Mgr. Jakub Oliva, LL.M., MSc., the leading attorney of the Olomouc office, who specializes in labor law and has extensive experience in labor inspections, collective disputes and labor law proceedings. Mgr. Bc. Kryštof Pažourek, a law clerk who focuses on labour law and private law disputes.

Thanks to the professional work of our team, we helped our client defend his rights and contributed to the protection of the stability of employment of persons with disabilities in the Czech Republic.
