Ensuring smooth transfer of photovoltaic power plants and minimizing legal risks
ARROWS provided comprehensive legal support to clients who lost their right to a licence to produce electricity from renewable energy sources (RES) due to failure to meet the integrity requirement.
In order to minimize the risk of losing the support for electricity production and to ensure the protection of clients' rights, the transfer of photovoltaic power plant (PV plant) operations to other entities was carried out.
Our legal services included analyzing legal and regulatory requirements, drafting and negotiating PV plant transfer agreements, communicating with regulatory authorities, and coordinating all steps necessary for a successful transfer. A key element was ensuring compliance with relevant legislation and minimising the risks associated with the licence transfer.
This project was a demonstration of excellent teamwork. Mgr. Lukáš Nálevka, who specializes in energy and corporate law, and regularly advises entrepreneurs and energy companies on regulatory requirements, contractual documentation and changes in the internal structure of companies. His expertise and experience were crucial to the successful completion of the transaction.
