Representing a client in a dispute for damages against the Czech Republic

ARROWS successfully represented a client in a dispute against the Czech Republic for damages in excess of CZK 18 million.

The damage was caused by improper official conduct during bankruptcy proceedings initiated in 2002, when the bankruptcy court failed to properly supervise the activities of the bankruptcy trustee. That lack of supervision led to the bankrupt's assets being monetised on unfavourable terms and in breach of the court's instructions.

The legal services included the preparation of detailed arguments and representation of the client before the court, where it was proven that the maladministration caused the client significant financial losses. As a result, fair compensation was obtained, including both financial compensation and an acknowledgement of the state authorities' liability.

The team was led by Mgr. Lukáš Kubec, an experienced attorney specializing in the resolution of disputes arising from contractual legal relations and debt recovery. Thanks to his determination to achieve the best possible result and careful preparation, this case was successfully concluded in favour of the client.
