Successful representation of a client in a dispute over a contractual penalty for delay in remedying a defect in the work
ARROWS represented a client in a dispute over the payment of a contractual penalty for delay in removing a defect in construction work when groundwater penetrated the building.
The contractor denied liability for the defect, which led to court proceedings, a key element of which was an expert assessment.
The legal advice included the preparation and presentation of evidence, including expert reports proving the contractor's liability, strategic argumentation and representing the client in the court proceedings. Legal support included negotiating with the opposing party to reach an amicable resolution in the client's best interests.
